    No leader wants to face a tribunal. The idea alone is stressful. 
    But focusing on avoiding tribunals can create the wrong mindset - overly cautious, hesitant, afraid to act. 

    The truth is, most tribunal cases don’t start with one dramatic event. They build over time. 

    • Inconsistent conversations. 

    • Unclear expectations. 

    • Missing documentation. 

    • Different managers handling similar cases differently. 

    It’s rarely one big mistake. It’s drift. 

    The safest organisations aren’t the ones who avoid difficult decisions. They’re the ones who follow fair process.

    3. Consistent application of policy. 

    4. Opportunity for improvement. 

    5. Transparent communication. 

    Structure protects everyone. It protects the employee from arbitrary treatment. It protects the business from reactive risk. Acting early, documenting calmly and applying policy consistently does more to reduce tribunal risk than silence ever will. 

    Strong process isn’t about being defensive. It’s about being steady. And steady leadership rarely ends up in court.
